The Upfront Media website at www.beupfront.com and related domains, mobile applications, and other services (collectively, the "Service") are operated by Upfront Media Group, Inc., a Delaware corporation ("the Company," “we,” or “us”). We know that you care how information about you is used and shared, and we appreciate your trust that we will do so carefully and sensibly.  This privacy policy describes our Privacy Policy for the Service.  Capitalized terms used but not defined in this Privacy Policy shall have the meaning set forth in your Terms and Conditions with us. 

This Privacy Policy covers only information that is collected through the Service and does not cover websites to which we link.

Information We Collect and How We Use It

In general, we collect Personal Information (as defined below) in order to verify your identity, deliver the products and services that you have requested, help us maintain the appropriate features, functionality and user experience, enforce our terms and conditions, and manage our business.  We will retain your Personal Information for as long as your account is active or as needed to provide you with Services. We collect and store information, including Personal Information, that is voluntarily supplied to us by you when registering for, or using, the Service. You can choose not to provide us with certain information, but by doing so, you may not be able to take advantage of certain features and functionality of the Service.

Information We Collect About Users

We automatically track certain information based upon your use of the Service.  We use this information on our Users’ demographics, interests, and behavior to better understand, protect and serve you and our community and to provide our artists with better understanding of their audiences.

Log Files

Like many online services, we automatically gather certain information about our Service traffic and store it in log files.  This information includes Internet protocol (IP) addresses, browser type, Internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data.  We use this information, which does not identify individual users, to analyze trends, to administer the Service, to track users’ movements around the Service and to gather demographic information about our user base.

Communication from Us or the Service or Artists

Subscription-Related Communications
Depending on your subscription with us, you may receive text, video, photo, SMS, voicemail, email, and other communications from us, any artists you have subscribed to, or third party service providers, in each case in connection with such subscription. If you do not wish to receive them, you have the option to change your notification settings in your account page or deactivate your account.

Service-Related Announcements
We will send you strictly service-related announcements on rare occasions when it is necessary to do so.  For instance, if our service is temporarily suspended for maintenance, we might send you an email. Generally, you may not opt-out of these communications, which are not promotional in nature.  If you do not wish to receive them, you have the option to change your notification settings in your account page.

Customer Service
Based upon the Personal Information you provide us, we will send you emails to verify your username, password, and other information.  We will communicate with you in response to your inquiries, to provide and/or confirm the services you requested, and to manage your account.  We will communicate with you by email or telephone, in accordance with your wishes.  You may contact customer service at support@vertigoallaccess.com.

Provision of Service
Personal Information is shared with other parties in the following ways in order for us to provide the Service:

  • Your name, photo and  your memberships are displayed on your public profiles;
  • Information shared directly by Users might contain Personal Information; and
  • We may, with your consent, share Personal Information about you.

Third Party Service Providers
The Company works with a number of trusted partners that perform vital functions as part of our operations, including electronic payment service providers and content delivery service providers. Personal Information is shared with these third parties only to the extent necessary for us to process the transactions you initiate or subscription your order or perform other specific services required for us to provide you with the Service. Our partners are legally required to keep your information private and secure.

Aggregate Information (Non-Personally Identifiable)
We may share aggregated demographic information about our User base with our affiliates and our artists.  This information does not identify individual users.

We reserve the right to disclose your Personal Information as required by law and when we believe that disclosure is necessary to protect our rights; to comply with a judicial proceeding, court order, or legal process served on us or the Service; or in connection with an actual or proposed corporate transaction or insolvency proceeding involving all or part of the business or asset to which the information pertains.

Choice and Opt-out
We provide you the opportunity to ‘opt-out’ of having your Personal Information used for certain purposes, when we ask for this information.  If you no longer wish to receive our communications, if any, you may opt-out of receiving them by following the instructions included in each communication or by emailing us at support@vertigoallaccess.com.

The Service may contain links to other websites that are not owned or controlled by the Company.  Please be aware that we are not responsible for the privacy policies of such other websites.  We encourage you to be aware when you leave the Service and to read the privacy policies of each and every website that collects Personal Information. 

Access to Personal Information
If your Personal Information changes, or if you no longer desire the Service, you may correct, update, delete or deactivate it by making the change on your account page or by emailing our Customer Support at support@vertigoallaccess.com.

Please keep in mind that whenever you voluntarily make your Personal Information or other private information available for viewing by third parties online, that information can be seen, collected and used by others besides us.  We cannot be responsible for any unauthorized third-party use of such information.

The security of your Personal Information is important to us.  When you enter sensitive information on our registration or order forms, we encrypt that information using secure socket layer technology (SSL). 

We follow generally accepted industry standards to protect the Personal Information submitted to us, both during transmission and once we receive it.  No method of transmission over the Internet, or method of electronic storage, is 100% secure, however.  Therefore, while we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.
